| Law & The Chinese In Southeast Asia
HOOKER M. Barry (editor) . 216pp This collection of essays focuses on law and the diaspora Chinese. They show us a variety of answers to such questions as: what are the laws of China outside China; what are the laws of the Chinese in Southeast Asia; what were/are the laws for the Chinese in Southeast Asia; and is there a "Confucian Chinese"? The answers in some cases are reasonably certain but in others they are tentative and debatable. The legal material raises these issues in a way which is fundamental to diaspora studies. Contents: >Law & the Chinese Outside China: A Preliminary Survey of the Issues & the Literature (M Barry Hooker) >The Legal Position of the Ethnic Chinese in Indochina under French Rule (Melissa Chung) >Law & Memory, De Jure to De Facto: Confucianization & its Implications for Family & Property in Vietnam (Esta Ungar); English Law & the Invention of Chinese Personal Law in Singapore & Malaysia (M Barry Hooker); The Indonesian Chinese: 'Foreign Orientals', Netherlands Subjects, & Indonesian Citizens (Charles A Coppel); Chinese Family Firms in Indonesia & the Question of 'Confucian Corporatism' (Daniel Fitzpatrick); China's Citizenship Law & the Chinese in Southeast Asia (Leo Suryadinata) (For this item please quote stock ID 19261) ISBN: 9789812301253 |

China's Long March Toward Rule of Law
PEERENBOOM Randall 228 x 152mm. 600pp China has enjoyed considerable economic growth in recent years in spite of an immature, albeit rapidly developing, legal system, a system whose nature, evolution and path of development have been poorly understood by scholars. Drawing on his legal and business experience in China as well as his academic background in the field, Peerenboom provides a detailed analysis of China?s legal reforms. He argues that China is in transition from rule by law to a version of rule of law, though most likely not a liberal democratic version as found in economically advanced countries in the West. Maintaining that law plays a key role in China?s economic growth, Peerenboom assesses reform proposals and makes his own recommendations. In addition to students and scholars of Chinese law, political science, sociology and economics, this will interest business professionals, policy advisors, and governmental and non-governmental agencies as well as comparative legal scholars and philosophers. Features: >Contests the prevailing view that there has been no fundamental legal change in China >Provides a detailed analysis of China?s legal reforms by a scholar who has worked in international law in China >Addresses relationship between law, economic development & political reforms, & offers policy advice for foreign governments, aid agencies, & NGOs Contents: >Introduction >The evolution of rule of law in China: the role of law in historical context >Post-Mao reforms: competing conceptions of rule of law >Rule of law & its critics >Retreat of the party & State >The legislative system: battling chaos >The judiciary: in search of independence, authority & competence >The legal profession: the quest for independence & professionalism >The Administrative Law regime: reigning in an unruly bureaucracy >Rule of law & economic development >Rule of law, democracy & human rights >Conclusion: the future of legal reform (For this item please quote stock ID 19927) ISBN: 9780521016742 |

Asian Socialism & Legal Change: The Dynamics of Vietnamese & Chinese Reform
GILLESPIE John & NICHOLSON Penelope (editors) 340pp The immense process of economic and social transformation currently underway in China and Vietnam is well known and extensively documented. However, less attention has been devoted to the process of Chinese and Vietnamese legal change which is nonetheless critical for the future politics, society and economy of these two countries. In a unique comparative approach that brings together indigenous and international experts, Asian Socialism & Legal Change analyses recent developments in the legal sphere in China and Vietnam. This book presents the diversity and dynamism of this process in China and Vietnamthe impact of socialism, constitutionalism and Confucianism on legal development; responses to change among enterprises and educational and legal institutions; conflicts between change led centrally and locally; and international influences on, and interactions with, domestic legal institutions. Core socialist ideas continue to shape society, but have been adapted to local contexts and needs, in some areas more radically than in others. This book is the first systematic analysis of legal change in transitional economies. (For this item please quote stock ID 25046) ISBN: 9780731537150 |

True Crimes in Eighteenth-Century China: Twenty Case Histories
HEGEL Robert E 312 pp The little-examined genre of legal case narratives is represented in this fascinating volume, the first collection translated into English of criminal cases - most involving homicide - from late imperial China. These true stories of crimes of passion, family conflict, neighborhood feuds, gang violence, and sedition are a treasure trove of information about social relations and legal procedure. Each narrative describes circumstances leading up to a crime and its discovery, the appearance of the crime scene and the body, the apparent cause of death, speculation about motives and premeditation, and whether self-defense was involved. Detailed testimony is included from the accused and from witnesses, family members, and neighbors, as well as summaries and opinions from local magistrates, their coroners, and other officials higher up the chain of judicial review. Officials explain which law in the Qing dynasty legal code was violated, which corresponding punishment was appropriate, and whether the sentence was eligible for reduction. These records began as reports from magistrates on homicide cases within their jurisdiction that were required by law to be tried first at the county level, then reviewed by judicial officials at the prefectural, provincial, and national levels, with each administrator adding his own observations to the file. Each case was decided finally in Beijing, in the name of the emperor if not by the monarch himself, before sentences could be carried out and the records permanently filed. All of the cases translated here are from the Qing imperial copies, most of which are now housed in the First Historical Archives, Beijing. Robert E. Hegel is Liselotte Dieckmann Professor of Comparative Literature and professor of Chinese, Washington University, St. Louis. "Contains rich and valuable information that sheds light on a range of legal and social issues. These cases provide unique firsthand illustrations of the everyday struggles of the common people during a period of profound historical change and they illustrate the complex dynamics of the Qing legal system during the late imperial era." - Thomas Buoye, University of Tulsa Contents Preface and Acknowledgments Translator's Notes Introduction Part I Judicial Procedures Case 1: Xu Si: A Scuffle over a Debt (Jiangsu, 1792) Case 2: Li Huaiyu: The Missing Brother (Hunan, 1736) Case 3: Ms. Guo: Accidental Homicide Concealed (Zhili, 1794) Case 4: Li Cang: Blackmail and Arsenic (Shanxi, 1803) Case 5: Cao Ligong: Attempted Rape That Led to Murder (Zhili, 1803) Part II Interrogation Techniques Case 6: Du Huailiang: Adultery That Brought Disaster (Shandong, 1696) Case 7: Rui Meisheng: Manslaughter over an Outhouse (Anhui, 1722) Case 8: Jia Mingyuan: Accidental Homicide (Fengtian, 1796) Part III Intent and Premeditated Violence Case 9: Luo Zhongyi: Kidnapping (Guangdong, 1728) Case 10: Wang Azhen: Murder for Extortion (Guangdong, 1779) Part IV The Failure of "Confucian" Family Values 122 Case 11: Li Er and Li San: Two Pecks of Beans (Fengtian, 1738) Case 12: The Hong Brothers: A Quarrel over Manure (Hunan, 1738) Case 13: Ms. Wang: Incest and Violent Homicide (Jilin, 1738) Case 14: Ms. Ma: Disguised Poisoning (Shandong, 1795) Part V Control of Politically Marginal Groups and Individuals Case 15: A Village Vendetta and Han Intercession (Guangxi, 1728) Case 16: Rebellious Religious Sectarians (North China,1791-1814) Case 17: Ji Yanghua: Secret Society Member (Shanxi, 1814) Part VI Social Mobility and Crime Case 18: Jin San: A Spurned Lover (Sichuan, 1728) Case 19: Luo Fenpeng: A Phony Scholar-Official (Jiangxi, 1763) Part VII Imperial Intervention Case 20: Li Yuchang: A Magistrate Murdered for His Integrity (Jiangsu, 1809) Appendix 1. National Security & Fundamental Freedoms: Hong Kong?s Article 23 Under Scrutiny
FU Hualing, PETERSEN Carole J. & YOUNG Simon N.M. 236 x 158mm 524pp 'The debate on legislation to ensure the sovereignty and security of the PRC against threats from Hong Kong was a turning point in the Special Administrative Region?s political history. It showed that while some Hong Kong residents may have reservations about democracy, human rights are cherished by almost all. It also showed that people can influence policy even without formal institutions of democracy. The authors of this book played a leading role in the debate, clarifying the legal issues, which was critical to an informed debate' ? Yash Ghai, Sir Y.K. Pao Professor of Public Law, University of Hong Kong There has been intense interest in the proposals to implement Article 23, both in Hong Kong and abroad. The Limits of the Rule of Law in China
TURNER Karen G, et al Notes, index. 384pp In The Limits of the Rule of Law in China, 12 authors from different academic disciplines reflect on questions that have troubled Chinese and Western scholars of jurisprudence since classical times. Using data from the early 19th century through the contemporary period, they analyse how tension between formal laws and discretionary judgment is discussed and manifested in the Chinese context. The contributions cover a wide range of topics, from interpreting the rationale for and legacy of Qing practices of collective punishment, confession at trial, and bureaucratic supervision to assessing the political and cultural forces that continue to limit the authority of formal legal institutions in the People's Republic of China. | Asian Discourses of Rule of Law
PEERENBOOM Randall (editor) 234 x 156mm 512pp Rule of law is one of the pillars of the modern world, and widely considered necessary for sustained economic development, the implementation of democracy and the protection of human rights. | The Economic Contract Law of China: Legitimation & Contract Autonomy in the People?s Republic of China
POTTER Pitman B. Notes, appendices, bibliography, index. 246pp The Economic Contract Law, one of the cornerstones of China's post-1978 economic and legal reforms, is the first Chinese law to recognise the principle that the parties to contract transactions have rights that the state will recognise and enforce. This is in turn the first step toward broader recognition of contract autonomy, and marks a departure from preexisting collectivist norms. In this book Pitman Potter provides a broad-ranging analysis of ECL's potential for promoting contract autonomy in China. The effect of the EEL will depend on its acquiring both abstract legitimacy, through conceptual acceptance of its principles by economic actors, and also practical legitimacy, through actual reliance on the law. Potter examines the potential for abstract legitimacy through analysis of doctrinal discussions by the central political and legal communities. In discussing the ECL's potential to obtain practical legitimacy, he reviews 131 cases drawn from Chinese periodical that illustrate the recognition and enforcement of contract rights in operations. The extent to which the ECL acquires abstract and practical legitimacy will determine how effective the law will be in providing a basis for contract autonomy. Students and scholars of both Chinese and comparative law will find this book invaluable and will welcome Potter's analytical approach. | Copyright in China
QU Sanqiang 205 x 140mm. A thesis on a comprehensive study of copyright law and its jurisprudential basis in the PRC. It focuses on the examination of both the external conditions, which may affect or restrict the formation and development of the copyright law and policy in China, and the internal structure of the law which deals with liabilities for infringement of copyright. It reviews the tortuous process of development of the copyright theory and law in China, and explores the underlying influences of Chinese traditional culture and socialist political system upon this process. Copyright in China also analyses the significant influence of Western concepts of copyright on the theoretical and practical development of a Chinese system of copyright protection. It argues that the fundamental barriers to the development and operation of the copyright law in China result from the persistent gap between the notions that are forced upon the legal system and those embodied in social axiology. The thesis concludes that the traditional values inherent in Chinese theories and law of copyright are now being challenged by contemporary Western copyright ideas. The economic reform program and ?open door? policy implemented in China has intensified this challenge. To resolve this tension, China needs to adjust its law and policy to conform with the standards of copyright protection commonly accepted by international communities.
